OVERVIEW

The Bookboon eLibrary (hereafter solely referred to as the eLibrary) is a service provided and operated by Bookboon.com Ltd for you and employees of the company where you currently work.

ACCEPTANCE OF TERMS OF USE

These Terms of Use and Conditions govern your use of the eLibrary. By using the eLibrary, you accept and agree to these Terms of Use and Conditions.

WHO CAN USE THE ELIBRARY

The eLibrary delivered by Bookboon to your company, can only be used by employees currently working at your company.

USE AND SHARING OF CONTENT IN THE ELIBRARY

As a user of the eLibrary you are allowed to download all content available in the eLibrary. You are allowed to transfer downloaded content to any device you own or that your company has provided to you. You are also allowed to share downloaded content or links to the eLibrary with any colleague within your company.

You are NOT allowed to upload content from the eLibrary to any intranet or online service, such as, but not limited to, Sharepoint, Dropbox, and similar. You are also NOT allowed to make content you download in the eLibrary available to anyone outside of your company, or widely available to the public.

REGISTRATION OF INFORMATION ABOUT USERS

Anonymized information about your usage of this service will be made available to Bookboon and your company. This information may contain names of titles downloaded, and the results of any exams taken. The information will not contain your name, username, password, or any other personally identifiable information, unless this information is explicitly provided by you to us within your use of the eLibrary.

THIRD PARTY SITES, PRODUCTS AND SERVICES, LINKS

The eLibrary or content downloaded within it, may include links or references to other web sites or services solely as a convenience to you the user (“Reference Sites”). Unless otherwise expressly stated by Bookboon or your company, neither the eLibrary or your company officially endorses any such Reference Sites or the information, materials, products, or services contained on or accessible through these Reference Sites.

WEBSITE ACCESS

  1. As an employee at your company, you are granted permission to use the eLibrary as set forth in this Terms of Service, provided that: (i) your use of the eLibrary as permitted is solely for your work within your company; (ii) you will not copy or distribute any part of the eLibrary in any medium without Bookboon’s prior written authorization; (iii) you will not alter, download (except page caching) or modify any part of the eLibrary other than as may be reasonably necessary to use the eLibrary for its intended purpose; and (iv) you will otherwise comply with the terms and conditions of these Terms of Service. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Bookboon or the eLibrary or its affiliates without Bookboon’s express written consent. You may not use any meta tags or any other “hidden text” utilizing Bookboon’s or its affiliates’ name or trademarks without Bookboon’s written consent. Any unauthorized use terminates the permission or license you are granted herein. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the eLibrary so long as the link does not portray Bookboon, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter, and so long as the link is not made publicly available to people outside of the your company.
  • You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc., that accesses the eLibrary in a manner that sends more request messages to Bookboon’s servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, Bookboon grants the operators of public search engines permission to use spiders to copy materials from the eLibrary for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. Bookboon reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the eLibrary, nor to use the communication systems provided by the eLibrary for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the eLibrary.

INTELLECTUAL PROPERTY RIGHTS

The content in the eLibrary, including without limitation, the Manuscripts, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (“Content”) and the trademarks, service marks and logos contained therein (“Marks”), are owned by or licensed to Bookboon, subject to copyright and other intellectual property rights under Danish and foreign laws and international conventions. Except as otherwise provided for herein, Content on the eLibrary is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. The Company reserves all rights not expressly granted in and to the eLibrary and the Content. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of the eLibrary or features that prevent or restrict use or copying of any Content or enforce limitations on use of the eLibrary or the Content therein.

WARRANTIES AND LIABILITY

YOU AGREE THAT YOUR USE OF THE ELIBRARY SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKBOON, ITS AFFILIATES AND SUBLICENSEES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE ELIBRARY AND YOUR USE THEREOF. BOOKBOON MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE ELIBRARY’S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THE ELIBRARY AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE ELIBRARY, THE CONTENT AND THE MANUSCRIPT, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF BOOKBOON’S SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE ELIBRARY, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE ELIBRARY BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, E-MAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE ELIBRARY. BOOKBOON DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE ELIBRARY OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND BOOKBOON WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

LIMITATION OF LIABILITY

IN NO EVENT SHALL BOOKBOON, ITS AFFILIATES AND SUBLICENSEES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE ELIBRARY, ITS CONTENT OR MANUSCRIPTS, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF BOOKBOON’S SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE ELIBRARY, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE ELIBRARY BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, E-MAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE ELIBRARY, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

The eLibrary is controlled and offered by Bookboon from its facilities in Denmark. Those who access or use the eLibrary from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Privacy Notice

Bookboon recognizes that its customers, customers’ employees, users, and others who use the eLibrary (collectively or individually “Users”) value their privacy. This Privacy Notice details important information regarding the use and disclosure of User information collected on the eLibrary. Bookboon provides this Privacy Notice to help you make an informed decision about whether to use or continue using the eLibrary.

When using the eLibrary, Bookboon may collect the following Information about you:

  1. User Provided Information: Depending on how the eLibrary is set up for your company, you may be asked to provide certain personally identifiable information (such as your email address) to Bookboon when choosing to participate in various activities on the eLibrary such as downloading eBooks, audio files, or other content, by responding to surveys, taking exams, or subscribing to newsletters or other mailing lists. By providing this information while using the eLibrary, this information may be stored and processed by Bookboon, and your company, however, only in ways that have been approved in written form by your company. Bookboon will not use any of your personal information for its own commercial purposes.
  • Cookies Information: When you visit the eLibrary, we may send one or more cookies – a small text file containing a string of alphanumeric characters – to your computer that uniquely identifies your browser. Bookboon uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can set your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the eLibrary may not function properly if the ability to accept cookies is disabled.
  • Log File Information: When you use the eLibrary, our servers automatically record certain information that your web browser as standard sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.
  • Clear GIFs Information: When you use the eLibrary, we may employ “clear GIFs” (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients.

HOW BOOKBOON USES YOUR INFORMATION

If you submit personally identifiable information to us through the eLibrary, then we use your personal information to operate, maintain, and provide you with the features and functionality of the Websites. The information you enter may also be shared with your company and may be processed in ways we are instructed to by your company, in line with relevant international and local data protection regulations, such as GDPR. Bookboon will not process or use your information in ways not agreed to by your company or for Bookboon’s own commercial interests.

Any personal information or content that you voluntarily disclose online (on discussion boards, posting manuscripts in messages and chat areas, within your public profile page, etc.) becomes publicly available and can be collected and used by others.

We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent. We may, however, use your email address without further consent for informing you about new services of the eLibrary or new content being published that we think you might be interested in. You have the right to unsubscribe from any emails or newsletters sent by us, at any time.

We use your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the eLibrary, to customize the eLibrary to your interests and needs, and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends.

We use cookies, clear gifs, and log file information to: (a) remember information so that you do not have to re-enter information when you visit the eLibrary again; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as the total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

WHEN THE COMPANY DISCLOUSES INFORMATION

Information about your usage of this service will be made available to your Company. This information contains an identifier, titles of content downloaded, and the results of any exams you take. The information will not contain login and password information. We do not share your personally identifiable information (such as name or email address) with other, third-party companies for their commercial or marketing use without your consent or, except as part of a specific program or feature that has been agreed upon with by your Company, and for which you have the ability to opt-in or opt-out.

We do share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the eLibrary.

We may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with applicable international, national and local laws, or in response to a court order, subpoena, or search warrant.

Bookboon also reserves the right to disclose personally identifiable information and/or non-personally-identifiable information that Bookboon believes, in good faith, is appropriate or necessary in order to enforce our Terms of Use, take precautions against liability, to investigate and defend Bookboon against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the eLibrary, and to protect the rights, property, or personal safety of Bookboon, our employees, our Users, your Company and others.

YOUR CHOICES

You have the right to, at any time, decline to submit personally identifiable information through the eLibrary, in which case, the Bookboon may not be able to provide certain services to you.

OUR COMMITMENT TO DATA SECURITY

Bookboon uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to the Bookboon and you do so at your own risk. Once we receive your transmission of information, Bookboon makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If Bookboon is made aware of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Bookboon may post a notice on the eLibrary if a security breach occurs.

CHANGES AND UPDATES TO THIS PRIVACY NOTICE

This Privacy Notice may be revised periodically. The latest revisions will be noted by the “effective date” below. Please revisit this page to stay aware of any changes. Bookboon will only use your personal information in the manner described throughout this Privacy Notice. Your use and continued use of the eLibrary constitutes your agreement to this Privacy Notice and any future revisions.

For revisions to this Privacy Notice that may be materially less restrictive in how we use or disclose of the personal information you have provided us, we will attempt to obtain your consent before implementing such revisions.
